Preamble: Effectiveness of the General Conditions
These general sales conditions (hereinafter "General Conditions") regulate the purchase of products and services made at a distance and made available via the internet at the website www.tiberino.com/shop (hereinafter, the Website) in compliance with Italian legislation concerning distance contracts (Legislative Decree 70/2003).

The Customer, before placing an order, is required to carefully read these General Conditions, which are available on the Website to allow for reproduction and storage.
Contracts entered into with Sudalimenta S.r.l. through the Website are governed by these General Conditions in compliance with Italian law. The language available for concluding the contract is Italian.

Choosing and Ordering Products:
The features and price of each product are detailed on the product's specific page.
To purchase products, the Customer must complete and submit the electronic order form, following the instructions provided on the Website. The Customer must add the product to the "Cart" and, after reading the General Conditions and Privacy Policy, provide shipping and billing information, select the desired payment method, and confirm the order.
With the order confirmation, which serves as a contractual proposal, the Customer acknowledges and declares to have read all the information provided during the purchase process and to fully accept these General Conditions and the payment terms included.
The contract concluded between Sudalimenta S.r.l. and the Customer must be considered concluded when Sudalimenta S.r.l. accepts the order. This acceptance is communicated to the Customer through an order confirmation email.
If the Customer is a consumer (i.e., an individual who purchases products not related to their professional activity), after completing the online purchase process, they must print or save an electronic copy of these General Conditions, in compliance with Italian legislation on distance contracts.
The Customer does not have the right to damages or compensation, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or property caused by the failure to accept or process an order, even in part.
Product Information:
Information about products available for sale at a distance, along with their product codes, is provided on the Website.
The visual representation of products on the Website, where available, usually corresponds to the product's photographic image accompanying the description. It is understood that the image of the products serves only the purpose of presenting them for sale and may not be perfectly representative of their features but may differ in color and size. In case of discrepancies between the image and the written product description, the product description always prevails.
Prices:
Product prices include all taxes and fees. All prices are expressed in Euros.
Shipments in Italy:
Throughout Italy, shipping is free for orders with a value exceeding €25.
Shipments Abroad:
Shipping costs apply to all orders and vary depending on the destination country. When the Customer selects a destination other than Italy, shipping costs are automatically updated.
Payment Methods:
The Customer may make payments for products and related delivery fees using PayPal, bank transfer, or postal order.
PayPal:
After confirming the order, the Customer will be redirected to the PayPal website, where they can make the payment through their PayPal account or by using a credit card, including prepaid cards.
Bank Transfer:
The Customer must make the bank transfer within 3 days from the order date. Failure to do so will result in contact from Customer Service to clarify whether the Customer's failure to confirm the purchase is due to other causes.

Order Confirmation:
Upon receiving the order, Sudalimenta S.r.l. will verify the stock's availability for order processing. If a product is not available, Customer Service will promptly inform the Customer. The Customer may choose to confirm the shipment or cancel it.
Upon the execution of the contract, the Customer will receive an email confirming the receipt of the purchase order. This communication includes a summary of the general and specific conditions applicable to the contract, withdrawal terms, order number, shipping and billing information, the list of products ordered with their essential characteristics, price, and amount paid.
Transport and Delivery:
Products purchased on the Website will be delivered to the address indicated by the Customer during the purchase process. Any error attributable to the incorrect indication of the address or the data on
the door/intercom/bell, which prevents the courier from identifying the recipient of the shipment, may result in delayed delivery and/or additional shipping charges. In these cases, Sudalimenta S.r.l. cannot be held responsible for any possible delays and/or additional charges.
Sudalimenta S.r.l. issues an invoice for the delivered goods for each order made on the Website, sending it to the Customer in paper or digital format upon specific request via email at info@sudalimenta.com, or by phone at +39 080 5046600 (Mon-Fri 9:00 - 13:00 and 16:00 – 19:00). The information provided by the Customer during the purchase process is binding for the issuance of the invoice. No changes to the invoice can be made after issuance.
Any delivery charges are the responsibility of the Customer and are clearly indicated during the purchase process.
All purchases will be delivered by express courier (hereinafter, the "Courier") from Monday to Friday, excluding holidays and national holidays. Sudalimenta S.r.l. is not responsible for unforeseeable delays.
Once the Products are shipped, Sudalimenta S.r.l. will send a confirmation email to the Customer, including a link for tracking the shipment.
In any case, unless in cases of force majeure or unforeseen circumstances, the ordered Products will be delivered within 7 (seven) working days from the day following the day when the Customer placed the order with Sudalimenta S.r.l., unless Sudalimenta S.r.l. communicates, within the same period, the impossibility to deliver the ordered goods due to their unavailability, even temporarily. In case of such communication, the Customer may choose one or more alternative products. In the event that the Customer decides not to choose alternative products or to cancel the order, Sudalimenta S.r.l. will refund the sums already paid by the Customer within the same timeframe.
Right of Withdrawal:
Pursuant to articles 64 and following of the Consumer Code (Legislative Decree 2005/206), the Customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty.
To exercise this right, the Customer must send a communication to Sudalimenta S.r.l. within 10 working days from the date of receiving the goods.
This communication should be sent by registered letter with acknowledgment of receipt to:

Alternatively, it can be sent via fax to +39 080 5046600.
The fax communication must also be sent within the above-mentioned 10 working days and followed by a confirmation letter sent by registered mail with acknowledgment of receipt.
Once the communication is received, Sudalimenta S.r.l. will provide instructions to the Customer on how to return the goods.
The right of withdrawal is subject to the following conditions:
The right applies to the entire product purchased; partial withdrawal from the product is not possible.
By law, the Customer is responsible for shipping costs related to returning the goods.
The shipment, up to the certificate of receipt in our warehouse, is the complete responsibility of the Customer.
Sudalimenta S.r.l. is not responsible in any way for damages, theft, or loss of goods returned without insurance.
In case of damage to the goods during transport, Sudalimenta S.r.l. will notify the Customer of the incident (within 5 working days) to enable the Customer to report the issue to the courier and obtain any reimbursement. In this case, the product will be made available to the Customer for return, simultaneously canceling the withdrawal request.
Sudalimenta S.r.l. will refund the entire amount already paid by the Customer, within 30 days from the return of the goods, through a refund procedure via PayPal or bank transfer. It is the Customer's responsibility to provide their banking coordinates to receive the refund (ABI - CAB - Current Account of the invoice holder).
The right of withdrawal is entirely lost if the essential condition of integrity of the product (packaging and/or its contents) is not met, in cases where Sudalimenta S.r.l. finds:
The absence of the outer packaging and/or the wrapping containing the purchased product.
The damage to the product for reasons other than its transport.
In the event of the loss of the right of withdrawal, Sudalimenta S.r.l. will return the purchased product to the sender, charging the sender the shipping costs.
Free Returns:
Sudalimenta S.r.l. provides Customers with the possibility of replacing products purchased through the Website.
Customers who are not fully satisfied must keep all delivery documentation and the product itself in its original packaging and contact Sudalimenta S.r.l. by sending an email to info@sudalimenta.com or by calling at +39 080 5046600 (Mon-Fri 9:00 - 13:00 and 16:00 – 19:00). Sudalimenta S.r.l.'s Customer Service will coordinate with the Customer for the product's return.
Non-Conformity:
In the case of non-conformity of products sold by Sudalimenta S.r.l., the Customer must immediately contact us by email at info@sudalimenta.com.
Legal guarantees provided by articles 129, 130, and 132 of the Consumer Code apply to the sale of products. The Customer is entitled to the restoration, without charges, of the product's conformity by repair or replacement, or to a suitable price reduction or contract resolution. The Customer forfeits these rights if the defect of conformity is not reported to Sudalimenta S.r.l. within two months from the discovery date.
Errors:
The information provided through the Website about the products is continuously updated. However, the
complete absence of errors cannot be guaranteed.
Sudalimenta S.r.l. reserves the right to correct errors, inaccuracies, or omissions even after an order has been sent, or to change or update information at any time without prior notice.

Applicable Law and Competent Court:
The sales contract between the Customer and Sudalimenta S.r.l. is considered concluded in Italy and is governed by Italian law. To solve civil and criminal disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, territorial competence belongs to the court of their place of residence or elective domicile, located in Italian territory. In all other cases, jurisdiction is exclusively granted to the Bari Court.
